We are bound by the Privacy Act 1988 (Cth) (“Privacy Act“) and the Australian Privacy Principles (“APP“). This policy explains how and why we collect, use, hold and disclose your personal information.

We“, “us” and “our” means Axis Mining Technology Pty Ltd (ACN 164 873 278) of Unit 1, 47 McCoy Street, Myaree, Perth, Western Australia 6154 and its related bodies corporate.

A reference to “website” means the internet site at the domain www.axisminetech.com, https://onsite.axisminetech.com or any other website operated by us.

YOUR INFORMATION

We collect information about you and your interactions with us, for example, when you call us, submit an enquiry using our enquiry service or visit our website. The information we collect from you may include your identity and contact details, your history of use of our products and services and details of enquiries or complaints you make.

Specifically, when you visit our website, we collect information about how you access, use and interact with the website. This information may include:

WHY WE COLLECT, HOLD AND USE YOUR PERSONAL INFORMATION

We collect, hold and use your personal information so that we can:

(a) contact you, for example, to respond to your queries or complaints;

(b) comply with our legal obligations and assist government and law enforcement agencies or regulators; and

(c) better manage our service by identifying peak usage, busiest times and server needs.

If you do not provide us with your personal information we may not be able to provide you with our services, communicate with you or respond to your enquiries.

HOW WE COLLECT YOUR PERSONAL INFORMATION

We will collect your personal information directly from you whenever you interact with us. For example, through information you provide us through your use of the enquiry service on the website or the use of cookies when you visit the website.

We also collect your personal information when you register to use the Axis onSite™ platform. The Axis onSite™ platform is managed by Spring Cloud Tech Pty Ltd (ACN 605 787 513) (“SpringTech“). Upon registration, when you either provide us with your personal information or upload it to the Axis onSite™ platform, it is collected by us and subsequently disclosed to SpringTech as part of their management of the Axis onSite™ platform. Examples of the information disclosed to SpringTech are your name, username, email address and password. After registration any data, documents and information uploaded to the Axis onSite™ platform is collected by SpringTech directly by virtue of its management of the Axis onSite™ platform and may be disclosed to us as owner of the Axis onSite™ platform. Both SpringTech and us treat all data, documents and information uploaded to the Axis onSite™ platform as confidential and such data, documents and information will not otherwise be disclosed by either SpringTech or us unless you specifically authorise the release of such data, documents and information to the intended recipient.

HOW WE STORE AND HOLD PERSONAL INFORMATION

We store most information about you in computer systems and databases operated either by us or our external service providers. Some information about you may be recorded in paper files that we store securely.

These processes and systems include:

(a) the use of identity and access management technologies to control access to systems on which information is processed and stored;

(b) requiring all employees to comply with internal information security policies and keep information secure;

(c) requiring all employees to complete training about information security; and

(d) monitoring and regularly reviewing our practice against our own policies and against industry best practice.

We will also take reasonable steps to destroy or de-identify personal information once we no longer require it for the purposes for which it was collected or for any secondary purpose permitted under the APPs.

WHO WE DISCLOSE YOUR PERSONAL INFORMATION TO AND WHY

We may transfer or disclose your personal information to our related companies or our network of distributors.

We may disclose personal information to external service providers so that they may perform services for us or on our behalf. These external service providers have access to your personal information only to perform these services on our behalf and are obligated not to disclose or use it for any other purpose.

We may also disclose your personal information to others outside our group of companies where:

(a) we are required or authorised by law to do so;

(b) you may have expressly consented to the disclosure or the consent may be reasonably inferred from the circumstances; or

(c) we are otherwise permitted to disclose the information under the Privacy Act.

If the ownership or control of all or part of our business changes, we may transfer your personal information to the new owner.

DISCLOSURE OF PERSONAL INFORMATION TO OVERSEAS RECIPIENTS

We may disclose your personal information to recipients which are located outside Australia.

Those recipients are most likely to be located in locations where we conduct business including but not limited to Asia Pacific, Canada, the United States of America, South America, Central Asia, Europe, the United Kingdom, Africa and South East Asia.

We may also transfer your personal information to (and main such personal information on) computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction.

If you are located outside Australia and choose to provide information to us, please note that we transfer the data to Australia and process it in Australia.

Your consent to this policy followed by your submission of such information represents your agreement to that transfer.

We will take steps reasonably necessary to ensure that your data is treated securely and in accordance with this policy and no transfer of your data or personal information will take place to an organisation or a country unless there are adequate controls in place including the security of your data and other personal information.

PERSONAL INFORMATION AND MARKETING

If you have joined the Axis Mailing List we will use your personal information to send out periodical emails with latest information about new products, upcoming events and any information about our Company.

Where you receive electronic marketing communications from us, you may opt out of receiving further marketing communications by following the opt-out instructions provided in the communication.

ACCESS TO AND CORRECTION OF YOUR PERSONAL INFORMATION

You may access or request correction of the personal information that we hold about you by contacting us. Our contact details are set out below. There are some circumstances in which we are not required to give you access to your personal information.

There is no charge for requesting access to your personal information but we may require you to meet our reasonable costs in providing you with access (such as photocopying costs or costs for time spent on collating large amounts of material).

We will respond to you requests to access or correct personal information in a reasonable time and will take all reasonable steps to ensure that the personal information we hold about you remains accurate, up to date and complete.
